Doing business in Kosovo
Legal clarity for your next investment. A direct point of contact on the ground.
Entering a new market requires more than signing a contract. You need to understand the business structure, the rights you are acquiring and the obligations that follow. Arts Law Firm supports foreign investors, companies and entrepreneurs with Kosovo-law advice, transaction documents and local representation, from the first assessment through the operation of the business.
Led by Feim Maliqaj, our practice connects private legal work with experience in public administration, public finance and intellectual property. We turn the proposed project into a practical legal work plan: what to check, what to document and which institutions to approach.
From market entry to daily operations
- Business structure and registration. Advice on the appropriate entity or local presence, founding documents, shareholder arrangements, governance and coordination of applications to the Kosovo Business Registration Agency. We identify tax-onboarding questions and coordinate with accounting specialists where needed.
- Due diligence before committing. Review of corporate records, ownership, authority to sign, material contracts and potential disputes. For property projects, we examine available cadastral and title documents, encumbrances, contractual rights, permits and the conditions relevant to the proposed acquisition or use.
- Investment and commercial agreements. Drafting, review and negotiation of investment, joint-venture, shareholder, acquisition, lease, supply, distribution and service agreements, with attention to payment, delivery, liability, exit and dispute-resolution terms.
- Licensing and public-sector dealings. Assessment of applicable permits and sector requirements; support in communications with authorities, administrative procedures and challenges; advice on public-procurement participation and related contractual issues.
- People, brands and information. Employment agreements and workplace questions, protection and licensing of intellectual property, personal-data obligations and the legal terms of digital business and e-commerce.
- Disputes and continuity. Negotiation, commercial and administrative litigation, debt recovery and contractual dispute mechanisms, including arbitration where applicable. We also help organise the local steps required to protect an ongoing project.
A clear route through the project
- Understand the proposal. We discuss your objectives, parties, funding structure, sector and any existing deadlines or commitments.
- Assess the position. We review the documents, identify legal dependencies and explain the options, risks and further checks.
- Agree the work. We define the scope, fees and authority to act, then coordinate filings, negotiations and professional input with regular updates.
Local representation. Coordinated across borders.
Our advice and representation concern Kosovo law. When a project also involves another jurisdiction, we can coordinate with the relevant foreign counsel through professional collaborations in England, Slovenia and Italy. Each lawyer or specialist advises within their own jurisdiction and agreed role.
